It is clearly stated sa RA7920 New Electrical Eng'g Law na exempted ang OFW same sa CPE Primer (from your previous posting). I believe na hinde mag iissue ang IIEE ng isang  instruction without any basis.  Anyway, balitaan mo na lang ako sa mga development.  Wink

“THE PRC MODERNIZATION ACT OF 2000”
AN ACT MODERNIZING THE PROFESSIONAL REGULATION COMMISSION,
REPEALING FOR THE PURPOSE PRESIDENTIAL DECREE NUMBERED
TWO HUNDRED AND TWENTY-THREE, ENTITLED "CREATING THE
PROFESSIONAL REGULATION COMMISSION AND PRESCRIBING ITS
POWERS AND FUNCTIONS," AND FOR OTHER PURPOSES.


Sec. 20. Repealing Clause. – Republic Act. No. 546, Presidential Decree No.
223, as amended by Presidential Decree No. 657, Republic Act No. 5181, and
Executive Order No. 266, Series of 1995 are hereby repealed. Section 23 (h) of
Republic Act No. 7836, Section 4 (m & s). Section 23 of Republic Act No. 7920,
and Section 29 of Republic Act No. 8050, insofar as it requires completion of the
requirements of the Continuing Professional Education (CPE) as a condition for
the renewal of the license are hereby repealed. All other laws, orders, rules and
regulations or resolutions and all part/s thereof inconsistent with the provisions of
this Act are hereby repealed or amended accordingly.

yun na nga eh...problema pa ngani ay.. dahil nakaligtaan nila na may RA 8981 palan... siguro dahil malapit nanaman ang ANC sa Nov. 4-11 na kasi ... baka itong memo na ito ang kanilang strategy para dumami ang umatend sa ANC

hahahahaha maluya ngani talaga hamakin mo malapit na ang ANC hindi pa alam kung ilan ang credit CPE points???

Ang panlaban ata nila ay ang nakasulat sa RA7920 at RA 8981 ay CPE pinalitan nila ng CPD (continuing Professional Development) ano ngalang pareho laang yun di baga?

rule of thumb pre, a mere guidelines cannot repeal any law.

but ill google the ra 8981 pre and go through it quickly to find out if the issuance of the said guidelines have basis. purely sa CPE/CPD lang ba ang ti-nouch nung guidelines pre? or meron pang iba?

RE : CONTINUING PROFESSIONAL EDUCATION REQUIREMENT FOR EEs and RMEs




Effective 1 January 2009, all licensed Electrical Engineers and Electricians who are in the practice of electrical engineering and electricians shall be required to abide by the requirements, rules and regulations on continuing professional education (CPE) under the New Electrical Engineering Law (RA 7920) promulgated by the Professional Regulatory Board of Electrical Engineering in coordination with the Institute of Integrated Electrical Engineers of the Philippines, Inc. (IIEE).

The practice of electrical engineering and electricians under the New Law shall constitute an EE and RME in the practice on (RA 7920) design, consultancy, in education and in government. Licensed REEs, PEEs and RMEs in the practice of electrical engineering shall show proof of CPE requirement completion upon renewal of their professional licenses Identification Card.

The objectives of the CPE are as follows:

1. To provide and ensure the continuous education of EEs and RMEs with the latest trends in the electrical engineering profession brought about by modernization and scientific and technological advancements;

2. To raise and maintain the REEs, PEEs and RMEs capability for delivering professional services;

3. To attain and maintain the highest standards and quality in the practice of electrical engineering;

4. To make Filipino g REEs, PEEs and RMEs globally competitive; and

5. To promote the general welfare of the public.

The total CPE credit units required for EEs shall be forty five (45) units for three (3) years, provided that a minimum of fifteen (15) credit units shall be earned in each year and thirty (30) credit CPE units for RMEs for three (3) years, provided that a minimum of ten (10) credit units shall be earned in each year. Any excess credit units in one year may be carried over to the succeeding years within three-year period CPE credit units shall be granted only to accredited programs and providers.

The program and activities qualified for CPE credits include the following:

1. Participation in seminars and conventions as a resource speakers, panelist or reactor, facilitator or moderator, or as a seminar/convention participants.

2. Preparation for Masters or Doctorate Degree.

3. Completion of a self-directed package.

4. Authorship of published materials.

5. Inventions.

6. Completion of a postgraduate or in-service training.

7. Observations studies.

8. Completion of professorial chair requirements.

9. Other activities and programs recommended by the CPE Council and approved by PRC BEE.

All applications for CPE Provider, Program Accreditations and CPE certifications shall be made with the CPE Secretariat of IIEE at IIEE Building, # 41 Monte de Piedad, Cubao, Quezon City.

A processing and accreditation fee of Seven Thousand Pesos (P7, 000) shall be assessed upon submission of application papers for CPE Provider. Applicants outside the National Capital Region shall shoulder the transportation and accommodation expenses for at least two CPE accreditors for ocular inspection of facilities in connection with the application as CPE Provider.

In the event that your application as CPE Provider is approved, you may apply for the accreditation of your CPE programs. Separate guidelines will be issued for this purpose. If your application is disapproved, you shall get a refund of Five Thousand Pesos (P5, 000).

1) i presume ra 8981 is earlier than the memo/guidelines;

2) the memo's basis is a previously repealed law;

as to your question, my opinion is NO. nawala na yung basis ng memo, kase na-repeal na nga nung 8981 yung particular provision ng 7920 regarding CPE.

this particular statement provision in 8981 bears great effect on the guidelines :

"... All other laws, orders, rules and regulations or resolutions and all part/s thereof inconsistent with the provisions of this Act are hereby repealed or amended accordingly..."

moreso, if 8981 "relaxed" the CPE requirement, then that particular guidelines (even if it does not appear to amend the 8981) cannot be the amendatory instrument for 8981. it is not allowed.

have you pointed this out with the council/board? they may have missed the 8981..

Yun na nga ang point ko Arnie eh.. ang sabi nila hingi sila ng Help sa DOJ for their definition.. ang matindi nito nakapirma si Penalosa ang aming Board of electrical engineer na syang head ng Examinees sa PRC for EE... kaya hindi pwedeng mamiss-out nila ang RA8981... or kung namiss nga nila ... papano nila maipapaliwanag yun?Huh

Bread and butter kasi nila yang Annual Convention na yan na pwedeng isa sa source ng CPE points kaso nmilalangaw kasi kaya siguro nagpalabas sila ng guidlines... pero hindi nila ginagawa ang kanilang homework... thanks for the comment Arnie

delaying tactics lang yung hihingi pa sila opinion sa DOJ...

ka-klaro niyan... yung ginawa nilang legal basis nung memo is an already repealed law.

prob nyan pagdating sa DOJ, hindi naman masyado aasikasuhin yan kasi di naman political at controversial... maabutan na lang kayo nung convention lolz

okay lang sana na umatend ng COnvetion arnie wag lang silang maglabas ng ganung guidlines nakakahiya eh .....

Convention fee is Php 3500/ head... pero puro product presentation ang content ng kanilang technical session....

May isang magaling na EE arnie nandyan daw sa Cebu si Dominico "Doods" Amora
